Far West was an Arizona corporation that owned a sewage collection and treatment facility. On October 24, 2001, two employees, James Gamble and Gary Lanser, died in an underground tank while working after they were overcome by hydrogen sulfide gas. Another employee suffered severe injuries when he attempted to rescue them from the tank.
Far West was convicted for the deaths and was sentenced to multiple years of probation and fines totaling $1,770,000. Far West appealed, arguing that the criminal prosecution should be barred since they are a corporation and not a person.
