McLemore (Plaintiff) was a welder for nearly 30 years. He used welding rods made by Lincoln Electric (Defendant). In December 2001, Plaintiff experienced difficulty moving and welding with his left hand and arm. He was informed by a neurologist that he had Parkinsonism, which might have been related to welding, in September 2002. After visiting his attorney, he visited 6 more doctors. One of the doctors told him in December 2002 to stop welding. Plaintiff was finally diagnosed with manganism, a syndrome similar to Parkinsonism but caused by exposure to manganese, in 2005. Plaintiff first filed a lawsuit in February 2004, filed this particular suit on November 14, 2005, and amended this suit to name Defendants on March 3, 2006, serving them on March 14, 2006.
