Facts
The Appellant (Alaska Packers’ Association) contracted with the Appellees (various workers) to work a fishing season at their cannery in Alaska. Aside from a fixed amount of $50 or $60 for the season, the Appellees were also to be paid two cents for each salmon caught. Shortly after arriving, the Appellees demanded that the superintendent representing the Appellant pay them $100 for the season instead, or the workers would stop work and return to San Francisco. With little choice due to the remote location, the superintendent promised to pay them the higher amount, despite notifying the Appellees that he did not have the authority to modify the contract. Upon the return of the Appellees, the Appellant refused to pay the higher amount, and Appellees sued.
