Wynn (Plaintiff), a registered nurse, sued Verna Cole (Defendant), in her capacity as executive director of the Flint Visiting Nurses Association (VNA) and subsequently as director of the City of Flint Department of Public Health, for defamation, alleging that she maliciously published false statements concerning the plaintiff in evaluations of her work performance in order to cause injury. The statements about Wynn’s job performance were published, for purposes of this litigation, when they were supplied to an inquiring employer, the Flint Branch of the American Red Cross when Wynn applied for a job there.
