Trent Woodman, who was five years old, had his birthday party at an indoor play area operated by the defendant. Trent’s dad, before the party, signed a waiver of liability for Trent, releasing the defendant from liability for any injury that might occur while using their facilities. During the party, Trent broke his leg from jumping off of a slide. Trent’s mother then brought this claim. The defendant moved to dismiss it, relying on the signed waiver of liability. When that claim failed based on the common law, the defendant argued to change the common law.
