Willis v. State
Citation:
888 N.E.2d 177Facts
J.J. took Willis’s, his mother, clothes in a bag to school and gave them to another classmate. J.J.’s teacher thought this to be odd, so she contacted Willis and Willis came to the school and identified the clothes as hers. Willis sent her son to stay with her sister for the next few days to think about what to do with J.J. and this incident, as it is not the first incident and J.J. was a trouble child. When J.J. came back Willis questioned him about the incident. J.J. denied taking the clothes and tried to shift the blame on other students. Willis warned J.J. if he did not tell the truth he would be punished, but J.J. continued to lie. Willis then instructed J.J. to pull his pants down and Willis proceeded to strike J.J. 5 to 7 times on the buttocks with either a belt or an electric cord. J.J. in attempting to dodge the strikes received a few strikes on the arms and legs resulting in bruising. The next day J.J. went to the nurse’s office where the nurse saw the bruising and J.J. told the nurse it was from his mother and the nurse notified child protective services. Willis was arrested and charged with battery of a child which she was convicted of. Willis argues that she has the legal authority to discipline her son.
