In 1953, Oklahoma passed a law regulating the visual care industry. The statute prohibited opticians from fitting or duplicating eyeglass lenses without a prescription from a licensed optometrist or ophthalmologist, even when merely replacing broken lenses or putting old lenses into new frames. The law also prohibited anyone except licensed optometrists and ophthalmologists from advertising optical goods and services, banned the rental of space in retail stores by eye care professionals, and exempted ready-to-wear glasses from regulation. Lee Optical and other plaintiffs challenged these provisions as arbitrary restrictions on their business that violated their constitutional rights under the Due Process and Equal Protection Clauses of the Fourteenth Amendment.
