The Plaintiff (Drennan) was a general contractor bidding for a public contract. In line with typical practice, the Plaintiff fielded several calls the day of the bidding to hear bids from subcontractors to compute its own bid for the main contract. The requirements of the contract meant that the Plaintiff had to list every subcontractor it planned to hire, as well as offer a bidder’s bond as a guarantee that he would take the contract if offered. The Defendant (Star Paving) submitted a bid for $7,131.60 for the paving work. The Plaintiff was compiled his own bid relying on the Defendant’s quote, then submitted it and was awarded the contract. The Plaintiff, the next morning, met the Defendant, where the Defendant then notified that there had been a mistake in the Defendant’s bid. The Defendant refused to perform the work for less than $15,000, and the Plaintiff had to find another subcontractor to complete the work.
