The plaintiffs, Theresa White and Crawford White, filed a medical malpractice lawsuit against Dr. Alan Fisher, Dr. Phillip Gilbertson, and Lutheran Hospital. In their complaint, Theresa White alleged general damages of $500,000 and special damages of $10,000, while Crawford White alleged damages of $200,000. The defendants moved to dismiss the complaint for violating Wyoming Statute § 1-1-114, which prohibits stating dollar amounts in pleadings for personal injury claims. The plaintiffs moved to amend their complaint to remove the dollar amounts, explaining they had prepared the complaint hurriedly as the statute of limitations was about to expire. Despite this, the district court granted the motion to dismiss, citing a history of violations of the statute in that district.
