Ulysses C. Robbins, a U.S. Army sergeant in 1945, made deposits to a bank in Italy, instructing that the funds be held in an account in his name with his grandfather, plaintiff Wescott, as the designated beneficiary in the event of Robbins’ death, but with a five-year delay for disbursement. Robbins’ letter to the bank outlined these instructions, and the bank accepted the deposits. On February 24, 1945, Wescott deposited $800 sent by Robbins into a savings account, credited to Robbins’ name. Robbins was killed in action on June 19, 1945, and his death made the funds available for distribution.
