Michael Wartell (Plaintiff), who was the chancellor of Indiana University – Purdue University Fort Wayne (Defendant), filed suit against the university for sex discrimination and breach of contract after he allegedly experienced harassment and discrimination based on his sex and age. Wartell requested production of a report that had been prepared by an attorney conducting an internal investigation by the university about the matter. The independent investigator did not tell Wartell that he was acting as Purdue’s lawyer when he interviewed Purdue, and his report was not labeled as privileged or as an attorney-client communication. Purdue refused to produce it and asserted the attorney-client privilege. Wartell filed a motion to compel production of hte report.
