Warren v. Dinter

On August 8, 2014, Susan Warren, age 54, visited the Essentia Health clinic in Hibbing, Minnesota, presenting with abdominal pain, fever, chills, and other symptoms. Nurse practitioner Sherry Simon ordered tests that revealed unusually high white blood cell counts and other abnormalities, leading Simon to believe Warren had an infection requiring hospitalization. Simon called Fairview Range Medical Center to seek Warren’s admission, and her call was randomly assigned to Dr. Richard Dinter, one of three hospitalists on call. The ten-minute conversation between Simon and Dinter resulted in disagreement about what information was shared and Dinter’s exact response. Simon claims she shared abnormal test results and symptoms and specifically requested hospitalization, while Dinter claims Simon only asked whether Warren should be hospitalized. Both agree that Dinter attributed Warren’s abnormal test results to diabetes. After speaking with Dinter and consulting with her collaborating physician Dr. Baldwin, Simon prescribed diabetes medication and sent Warren home. Three days later, Warren was found dead in her home. An autopsy determined the cause of death was sepsis from an untreated staph infection.
