Plaintiff is a tenant of defendant in a shopping mall. The plaintiff’s lease agreement contained a clause that prohibited the defendant from renting space to another pharmacy in the mall. The defendant wanted to rent the largest and most profitable space in the mall to a deep discount store that also had a pharmacy in it. Plaintiff filed suit seeking injunctive relief preventing the defendant form renting the space to any tenant with a pharmacy. Defendant had an expert witness testify who contended that the plaintiff’s damages were calculable and that consequently money damages were appropriate despite the provision in the lease. Plaintiff sought to have the lease enforced according to its terms and prevent any pharmacy from renting space in the mall.
