Audrey E. Vokes, a 51-year-old widow with no previous dance training, was approached by Arthur Murray dance studios in 1961. Over a 16-month period, she was persuaded to purchase 2,302 hours of dance lessons for $31,090.45 through a series of 14 separate contracts. The studio representatives, including defendants J.P. Davenport and others, repeatedly told Vokes she had “dance potential,” was “rapidly improving,” and had “exceptional grace and poise.” They awarded her bronze, silver, and gold medals for dancing achievement despite her actual lack of progress. In reality, Vokes was a poor dancer who showed little improvement, and these statements were made solely to induce her to purchase additional lessons, exploiting her loneliness and desire for a new interest in life.
