Voest-Alpine Trading Co. v. Bank of China

Voest-Alpine Trading Company entered into a contract to sell steel products to Jiangyin Foreign Trade Corporation (JFTC), a Chinese company. To secure payment, JFTC arranged for the Bank of China to issue a letter of credit in favor of Voest-Alpine. After shipping the goods, Voest-Alpine presented the required documents to the Bank of China through its advising bank. Although the documents strictly complied with the terms of the letter of credit, the Bank of China refused to honor it, claiming that JFTC had instructed them not to pay because of alleged quality issues with the steel products. Voest-Alpine maintained that the documents were in order and that any dispute regarding the quality of goods was separate from the bank’s obligation to honor the letter of credit.
