In May 1974, Plaintiff filed a motion for judgment against the Holts, jointly and severally, seeking recovery of the face amount of a $6,000 promissory note. The instrument was payable to Plaintiff and allegedly made by the Holts to evidence their indebtedness. The note had been dated December 12, 1973, and was due 90 days after date. Edgar Holt failed to appear and a default judgment was entered against him in August 1974. Gustava Holt generally denied liability and specifically denied that the instrument was signed by her. Judgment was entered on a jury verdict in her favor and Plaintiff was granted a writ of error. Plaintiff appealed the judgment to the Virginia Supreme Court.
