Facts
During the course of business, the defendant moored its steamship to the plaintiff’s dock. While unloading cargo from the ship, a storm developed. When the defendant’s employees had finished unloading, the storm had grown violent. The wind began moving at 50 miles per hour and continued to increase during the night. Rather than battle the storm, the defendant chose to keep the ship moored to the dock. As a result, the ship was constantly lifted by the wind and thrown against the dock, resulting in $500 in damage.
