YouTube was founded in 2005 as a website that allowed users to upload, share, and view video content. By 2010, the site had over 1 billion daily video views with more than 24 hours of new video uploaded every minute. Google acquired YouTube in 2006 for $1.65 billion. Viacom and other copyright holders filed lawsuits alleging that YouTube was hosting approximately 79,000 infringing video clips between 2005 and 2008. Internal communications suggested YouTube executives were aware of some infringing content on the platform. YouTube had implemented a system to respond to takedown notices from copyright holders and had various automated software functions to process and display videos, including transcoding videos into different formats, playback functions, and related video recommendations. The plaintiffs claimed YouTube had actual knowledge of specific infringing activity and was willfully blind to infringement occurring on its platform.
