Universal Camera Corporation discharged an employee named Chairman shortly after he testified at a National Labor Relations Board hearing. The NLRB investigated and concluded that the discharge constituted an unfair labor practice, specifically that Chairman was terminated for giving testimony under the Wagner Act. This determination was made despite the hearing examiner’s contrary findings that Chairman was discharged for legitimate reasons. The Board ordered Universal Camera to reinstate Chairman with back pay and to cease and desist from discriminating against employees who file charges or give testimony under the Act. The Court of Appeals for the Second Circuit enforced the Board’s order, holding that it was barred from considering the examiner’s report where it conflicted with the Board’s findings and that the Board’s decision was supported by substantial evidence.
