Kaiser Aluminum operated a plant in Gramercy, Louisiana, where prior to 1974, only 1.83% of skilled craftworkers were black, despite the local workforce being approximately 39% black. This disparity resulted from Kaiser’s practice of hiring only workers with prior craft experience, which few blacks had due to historical exclusion from craft unions. In 1974, Kaiser and the United Steelworkers of America implemented an affirmative action plan that established on-the-job training programs for unskilled workers to become craftworkers. The plan reserved 50% of training positions for black employees until the percentage of black craftworkers at the plant matched the percentage of blacks in the local labor force. Brian Weber, a white production worker, applied for the program but was rejected while black employees with less seniority were accepted. Weber filed a class action lawsuit alleging racial discrimination in violation of Title VII.
