Criminal Law Keyed to Kadish
United States v. Vasquez
Citation:
No. 22-1294 (10th Cir. 2024)Facts
Law enforcement obtained a warrant to search Vasquez’s residence and electronic devices for evidence related to drug trafficking activities. The warrant authorized the search of computers, cell phones, and other digital storage devices for communications, records, and other information related to drug distribution. While executing the search warrant and examining the contents of Vasquez’s devices, investigators discovered multiple files containing child pornography. The search was conducted using forensic software that allowed investigators to view file names, metadata, and content. Vasquez was subsequently charged with possession of child pornography under federal law. He moved to suppress the evidence, arguing that the discovery of child pornography exceeded the scope of the warrant, which was limited to evidence of drug trafficking.
