In October 1946, the United States operated major bituminous coal mines under Executive Order 9728, issued pursuant to the War Labor Disputes Act. Terms of employment were governed by the May 29, 1946 Krug-Lewis agreement between Secretary of Interior Krug and United Mine Workers President John L. Lewis. On October 21, Lewis sought to terminate this agreement, claiming authority under a termination clause from a prior 1945 agreement. The government denied any contractual right to terminate during government possession. After conferences failed, Lewis issued formal termination notice on November 15, effective November 20. The government filed suit seeking declaratory judgment and obtained a temporary restraining order on November 18. Despite the order, miners began a gradual walkout on November 18, with a full strike by November 20. The government then sought contempt citations. After hearings, the District Court found both defendants guilty of criminal and civil contempt, fining Lewis $10,000 and the union $3,500,000.
