Midwest Television, licensee of KFMB-TV in San Diego, petitioned the Federal Communications Commission for relief against respondents’ CATV systems, which transmitted signals from Los Angeles broadcasting stations into the San Diego market. Midwest alleged that this importation of distant signals fragmented the San Diego audience, reduced advertising revenues for local stations, and threatened to curtail local broadcasting services. The CATV systems received broadcast signals, amplified them, transmitted them by cable, and distributed them to paying subscribers without compensating the original broadcasters. The Commission, after reviewing responsive pleadings but without conducting evidentiary hearings, issued an order restricting expansion of respondents’ service in areas where they had not operated as of February 15, 1966, pending full hearings on the merits. The order was designed to preserve the existing situation while the Commission determined whether the CATV operations were consistent with the public interest.
