Ruiz was arrested for drug possession. The Government offered her a “fast track” plea bargain, which asked the defendant to waive indictment, trial and appeal. The agreement required that the defendant waive the right to receive information supporting any affirmative defense the defendant raises if the case goes to trial. Ruiz would not agree to the waiver, so the prosecutors withdrew their bargaining offer. At her sentencing, Ruiz asked the judge to grant her the same sentence the Government would have recommended if she had accepted the fast-track agreement. The Government opposed her request, the District Court denied it and she received a standard sentence instead.
