Ramirez-Cortinas (Defendant) was a Mexican citizen who illegally entered the United States at least six times since 1998. In 2008, after being charged with sexually abusing his stepdaughter, he was convicted of bail jumping and served four years in prison. He was then deported to Mexico in 2013. In 2018, he was discovered living in Texas and was arrested. He was charged with attempted illegal reentry into the U.S. following deportation, in violation of 8 U.S.C. § 1326. The court dismissed his illegal-reentry indictment, and the government appealed to the Fifth Circuit.
