The United States Environmental Protection Agency (EPA) conducted cleanup operations at a hazardous waste site in Cadillac, Michigan, known as the “Northernaire Plating Site.” R.W. Meyer, Inc. owned the land where Northernaire Plating Company had operated an electroplating business that disposed of hazardous substances. After the company went bankrupt, the EPA performed remedial actions at the site and incurred costs of approximately $293,000. The United States then filed suit against R.W. Meyer and other potentially responsible parties under CERCLA to recover these costs, including the attorney fees and litigation expenses associated with the enforcement action. R.W. Meyer contested the government’s ability to recover attorney fees as part of the response costs.
