Facts
Acme is a retail food chain that has around 36,000 employees, 874 retail outlets, 12 general warehouses, and 4 special warehouses. The Food and Drug Administration (FDA) advised Park by letter of unsanitary conditions in a few of Acme’s food storage warehouses relating to rodent infestation. The FDA inspected the locations and found evidence of rodent infestation and other unsanitary conditions. Around 4 months later a second inspection was conducted, and while the conditions were improved there was still evidence of rodent activity in the building, and there were rodent contaminated food lots. This was all part of the government’s evidence at trial. Park admitted to receiving the letter and stated that he had been told the president of the operations in the area of the warehouse was going to have the matter fixed.
Park was found guilty, and Park appeals stating that the jury instructions were erroneous because it essentially made Park criminally liable for just being the CEO of Acme. The appeals court agreed and reversed the conviction and remanded.
