Defendant arranged to sell drugs to Melvin Beasley with his friend Lorenzo Colbert. At the drug sell, defendant sold chalk for cocaine and Mr. Beasley paid $2,700 for it. As they were leaving the deal, Mr. Beasley realized he had been duped and pulled alongside the defendant and Mr. Colbert’s car. Mr. Beasley’s passenger saw Mr. Colbert cock his gun and four shots were fired, but ducked so he did not knew who fired which shots. Two days later the defendant was interviewed by the police. He admitted to shooting the rear window of the car, and after his initial shot, Mr. Colbert fired two shots.
Defendant was convicted for second degree murder at the district court level under a foreseeability standard, that his actions could foreseeably lead to the killing of another person.
