Mr. Madoff was involved in fraudulent behavior for over 20 years. The fraud reached thousands of victims and some $170 billion flowed into his business as a result of his scheme. Investors, charities, pension funds, and institutional clients were repeatedly lied to, as they were told their money would be invested in stocks when they were not. The victims made important life decisions based on these fictitious account statements.
Mr. Madoff used large sums of the funds for personal use and the use of his families and colleagues. He essentially turned himself in and confessed to the FBI, after he realized he would be caught soon. The Court is now deciding his punishment through a sentencing hearing. There was not a single letter submitted by friends, families, or colleagues to vouch for Mr. Madoff’s good deeds, good character, or civic or charitable activities. Based on a life expectancy analysis, Mr. Madoff has a life expectancy of 13 years, so he therefore asked for a sentence of 12 years or alternatively 15 to 20 years.
