Respondent was prosecuted on charges of mail fraud and tax evasion. He was issued a subpoena calling for production of different documents. He then appeared before the grand jury and invoked his Fifth Amendment privilege against self-incrimination. The prosecutor then issued an order directing him to respond to the subpoena and granting him immunity to the extent allowed by law. Respondent then produced the documents. On the basis of information obtained from those documents, he was charged a second time with various tax-related offenses.
