United States v. Hollow Horn
Citation:
523 F.3d 882 (8th Cir. 2008).Facts
R.R.A. became scared and ran to her grandmother’s house to sleep, leaving the nearby tent where her cousins were planning to camp out. While at her grandmother’s, R.R.A. was laying on the couch when her uncle entered the room wearing only his underwear. Hollow Horn then proceeded to remove the covers on R.R.A. then touched & rubbed her vagina.
Hollow Horn proceeded to walk to the tent where the other girls were sleeping. H.C. (ten-years old) was awakened in the tent by Hollow Horn rubbing her breasts in a circular motion. Hollow Horn also attempted to remove her underwear, but complied when she told him to stop.
During trial, and after an offer of proof by the government, Laudine testified that Hollow Horn had attempted to rape her when she was twenty-years old, several years prior. The rape charge was not prosecuted due to pressure from other family members.
