Various operators of hotels, restaurants, hotel and supply companies, and other businesses in the Portland area formed an association to attract conventions to their city. To finance the association, the members made contributions in predetermined amounts. To facilitate these collections, hotel members were asked to give preferential treatment to suppliers who paid their contributions. Hilton Hotels Corporation (“Hilton”) (plaintiff) was one of the businesses who gave preferential treatment to those who paid their association dues. By doing so, Hilton was charged and convicted of violating the Sherman Act.
