The appellees were charged by information with violating the Federal Regulation of Lobbying Act. Seven counts were filed under Section 305, which requires reports from persons receiving contributions or expending money to influence legislation. One count charged the National Farm Committee with failing to report solicitation and receipt of contributions to influence agricultural commodity price legislation. Six counts charged defendants Moore and Harriss with failing to report expenditures for the same purpose, including payments for face-to-face communications with Congress members and costs of letter-writing campaigns. Two additional counts under Section 308 alleged that Moore and Linder were hired to influence agricultural legislation without registering as required. The defendants arranged for Congress members to be contacted directly or through stimulated letter campaigns. The District Court dismissed all charges, ruling the Act unconstitutional based on vagueness and First Amendment grounds.
