In 1999, Scott Ansaldi, along with others, began selling a product called “Invigorating” containing GHB through a business named Scott’s Supplies. When legislation was pending to prohibit GHB, they switched to selling “Verve,” which contained GBL, water, blueberry Kool-Aid, and sugar. They purchased Verve exclusively from Rodney Gates. Even after the passage of the Date-Rape Drug Act in 2000, which scheduled GHB as a controlled substance, they continued selling Verve. The government presented evidence that both Ansaldi and Gates sold Verve for human consumption and knew that GBL converted to GHB upon ingestion. An expert testified about the chemical similarity between GBL and GHB molecules. Although some GBL actually converted to GHB in the bottle, no evidence suggested either defendant was aware of this fact. The defendants were convicted of conspiracy to distribute GHB, conspiracy to distribute GBL as a controlled substance analogue, and conspiracy to launder money.
