Defendant, Aluminum Limited, was incorporated in Canada in 1928 to take over properties of Defendant, Aluminum Company of America (“Aluminum Co.”), that were located outside of the United States. The U.S. government brought suit under the Sherman Antitrust Act, alleging that Aluminum Co. was monopolizing interstate and foreign commerce in the manufacture and sale of virgin aluminum ingot. The U.S. further claimed that Aluminum Limited had entered into a conspiracy in restraint of aluminum commerce.
