Guardiola (Plaintiff) reported that while working at Renown Health (Defendant), she discovered a scheme whereby Renown knowingly submitted false inpatient reimbursement claims to Medicare that should have been billed on a less expensive basis. The United States initiated a False Claims Act action against Renown Health. During discovery, Guardiola sent document requests for the time period between 2006 and 2014, but the production had a “gap period” between 2011 and 2013 where emails were missing. Renown claimed that these emails were on a series of backup tapes that required time and expense to produce. Guardiola filed a motion to compel these documents.
