Sue Allbritton (Plaintiff), an employee at Texaco Chemical Company’s facility, was injured during an incident at the facility. After helping put out a fire caused by a pump manufactured by Union Pump Co. (Defendant), Plaintiff helped her supervisor block a nitrogen purge valve. On the way back, the Plaintiff followed her supervisor across a pipe rack, that may have been wet from the fire. She hopped or slipped off the pipe, and was injured. Plaintiff sued Defendant for under theories of negligence and strict liability, arguing that she would not have slipped but for the fire pump fire.
