Defendant hired plaintiff to lead six high holiday services during September 1950 for $1,200. The rabbi of the congregation had made assurances to plaintiff that the synagogue set-up would comply with Jewish religious law and contain separate seating for men and women. Plaintiff was aware that defendant congregation was moving to a new synagogue but had assurances that the new venue would comply with Jewish religious law. The new synagogue did not provide for separate seating and therefore plaintiff was unable to lead the high holiday services there and, at that point, could only secure a position for $100. Plaintiff sued for breach of contract.
