Criminal Law Keyed to Kennedy
U.S. v. Carson
Citation:
870 F.3d 584 (2017)Facts
Kaitlin Fratto’s neighbor, Christopher Richardson, asked her if she would be interested in working in an escort business ran by the defendant. She was only seventeen but in need of money and expressed interest. Richardson drove her to a motel to meet the defendant, and the defendant raped her and threatened to kill her. He then took provocative pictures of her and used them to advertise for prostitution services. He arranged for commercial sex transactions to take place and threatened to kill Fratto if she did not get him money. There were other victims he forced into sex trafficking as well.
At trial, the defendant wanted to elicit testimony that his victims had willingly and voluntarily worked as prostitutes in the past. The court did not allow him to do so. The defendant was convicted of engaging in sex trafficking with knowledge that the victims were forced, threatened, or coerced.
