Constitutional Law Keyed to Feldman
Trump v. Mazars USA, LLP
Citation:
140 S. Ct. 2019 (2020)Facts
In April 2019, three committees of the U.S. House of Representatives (the Financial Services Committee, the Intelligence Committee, and the Oversight Committee) issued four subpoenas to President Trump’s accounting firm (Mazars USA) and financial institutions (Deutsche Bank and Capital One). These subpoenas sought a decade’s worth of financial records related to President Trump, his family members, and affiliated businesses. The committees justified these requests as necessary for considering legislation on issues including money laundering, terrorism financing, foreign interference in U.S. elections, and financial disclosure requirements. President Trump sued in his personal capacity to block compliance with the subpoenas, arguing they lacked legitimate legislative purpose and instead sought to expose his personal affairs or conduct law enforcement activities beyond Congress’s authority. The President did not assert executive privilege over any of the requested documents, as they were personal rather than official records.
