Tronitech, Inc. filed a lawsuit against NCR Corporation and subsequently requested production of various documents during the discovery phase. NCR’s responses to these requests were deemed inadequate by Tronitech, who then filed a motion to compel discovery and for sanctions. The court found that NCR had failed to conduct a reasonable search for responsive documents and had provided incomplete and evasive responses. NCR’s corporate representative was unable to explain the company’s document retention policies or confirm whether a thorough search had been conducted. The court determined that NCR’s conduct demonstrated a lack of good faith in complying with its discovery obligations.
