Plaintiffs, Trinity Homes, and Seabring Development, with their agent, Stewart, attempted to enter into an agreement with Defendants, Ching Seng Fang and Carol S. Fang, and their agent, Nicholson for the sale of the Defendant’s property. When attempting to accept the offer to sell, Stweart allegedly placed the Agreement for Purchase & Sale of Real Estate (Agreement) in his facsimile machine, dialed Nicholson’s number, pushed the button to send, and went on an errand. However, there was no verification that a facsimile was transmitted and/or that Nicholson received it. Soon after, Nicholson called Stewart to tell him that Defendants did not wish to sell their property nor enter into an agreement with Plaintiffs. As a result, plaintiffs filed suit against Defendants.
