The Town of Beloit owned a 20.4-acre parcel of land along the Rock River that had a complex ownership history, including purchase by Caterpillar Company and subsequent repurchase by the Town. After selling 37 acres to the Wisconsin Department of Natural Resources for conservation, the Town retained the remaining parcel for residential development. Following years of unsuccessful attempts to attract acceptable private development proposals in the 1980s and 1990s, the Town decided in 1997 to develop the land itself as the Heron Bay Subdivision. The Town authorized expenditure of over $600,000 in tax revenues for planning, platting, and infrastructure development, including sewer and water systems. The development was reduced from thirty-six to twenty-four lots and included a 300-foot environmental easement along the Rock River. The Town’s stated purposes included creating jobs, increasing the tax base, promoting orderly growth, and preserving environmentally sensitive areas.
