The Toilet Goods Association and 39 individual cosmetics manufacturers brought an action seeking declaratory and injunctive relief against a regulation promulgated by the Commissioner of Food and Drugs. The regulation, issued under the Color Additive Amendments to the Federal Food, Drug, and Cosmetic Act, allowed the Commissioner to suspend certification services to manufacturers who refused to permit FDA inspectors access to manufacturing facilities, processes, and formulae involved in the manufacture of color additives. The plaintiffs argued that this regulation exceeded the Commissioner’s statutory authority, as Congress had consistently denied the FDA such broad inspection powers except for prescription drugs. The regulation was formally promulgated after notice and evaluation of submitted comments, constituting “final agency action” under the Administrative Procedure Act.
