David Smith, a teacher and debate coach at Highland High School employed by the Salt Lake City School District, selected eight students including Erin Anderson, Matt Ehrman, Brian and Jeff Horman, and Eric Sabodski to compete in a debate tournament at the University of Southern California. Smith and assistant coach Christian Bradley transported the students in two rented minivans. Following the tournament, Bradley drove one van with five students as passengers back to Utah. While traveling through Millard County late that evening, Bradley negligently lost control of the vehicle, which flipped several times and ejected three students. Eric Sabodski and Jeff Horman were killed, while Erin Anderson sustained severe traumatic brain injury, Brian Horman suffered crushed vertebrae and fractures, and Matt Ehrman injured his knee with multiple contusions. The parties agreed that aggregate damages exceeded $500,000, but the Utah Governmental Immunity Act capped total recovery at that amount.
