The defendant supplied James Gray and Michael Burk with information about the contents and layout of his sister in law’s house. He also discussed with them the method to be used, how they should dress, and how much to sell the loot for. However, Gray testified that the defendant stated he wanted no part of it shortly before the robbery and afterward, he expressed anger that the robbery had been committed and that Burk had no disguised himself.
They used that information to break in and steal her stuff. The defendant was convicted of robbery, burglary, false imprisonment, destruction of telephone equipment and assault with intent to commit a felony. It rested on the theory that he aided and abetted James Gray and Michael Burk. The Court denied the defendant’s request to instruct the jury that aiding and abetting requires proof of the criminal intent to aid.
