The Jaybird Democratic Association was a private political organization in Fort Bend County, Texas, that had been operating since 1889. It excluded Black citizens from membership and participation in its elections. The Association conducted pre-primary elections among its white members to select candidates for the Democratic Party primary. Due to the overwhelming Democratic majority in the county, the winners of the Jaybird primary invariably won the Democratic primary and the general election. This system effectively disenfranchised Black voters by making their votes in the official primaries and general elections meaningless, as the real selection of county officials occurred in the racially exclusive Jaybird primary. The plaintiffs, Black citizens of Fort Bend County, sued to have this system declared unconstitutional.
