The Tennessee Valley Authority began constructing the Tellico Dam on the Little Tennessee River in 1967, with Congress appropriating funds for the project annually. In 1973, a University of Tennessee ichthyologist discovered the snail darter, a previously unknown species of perch, in the portion of the river that would be impounded by the dam. The fish was subsequently listed as endangered under the Endangered Species Act, and its critical habitat was designated as the area threatened by the dam. By this time, the dam was approximately 80% complete with over $100 million already invested. Despite this substantial investment, environmentalists filed suit to permanently enjoin completion of the dam, arguing that it would destroy the snail darter’s habitat in violation of the Endangered Species Act.
