Tennessee v. Lane
Facts
George Lane (P) and Beverly Jones (P) are both paraplegics who use wheelchairs. George Lane (P) had to attend the courthouse to answer to criminal charges. Since the place had no wheelchair accessibility, he had to crawl up several flights of stairs on hands and knees. Beverly Jones (P) was a court reporter but could not attend several hearings because the county courthouses in which they were held had no access facilities for the disabled. She had lost both her work and the chance to take part in the court process. Both of them sued Tennessee on the ground that it had violated Title II of the ADA, by not giving them access to the state judicial system or to its services because of their disability. The federal district court denied the motion filed by Tennessee to dismiss the case. The circuit court of appeals affirmed the decision. Tennessee appealed.
