Caldwell (defendant) agreed to let Taylor (plaintiff) rent the Surrey Gardens and Music Hall for four days—June 17th, July 15th, August 5th, and August 19th—in exchange for one hundred pounds per day. Taylor planned to use the venue for the purpose of giving four concerts, followed by night fetes. Before the first concert was to be given, the venue was destroyed by a fire. The fire occurred without the fault of either party. Taylor sued Caldwell to recover for losses sustained from the advertising and other preparation for the concerts and fetes.
